This Consumer Health Data Privacy Notice (“Notice”) supplements the information contained in the Privacy Policy of Perry Street Software (“we,” “our” or “us”) at https://www.perrystreet.com/legal/privacy and applies in certain circumstances solely to all natural persons who are Washington residents, or natural persons whose consumer health data is collected in Washington (“consumers” or “you”). “Consumer health data” individually or collectively as applicable means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present or future physical or mental health status. The term “Service” as used in this Notice shall have the meaning given to it in our Privacy Policy.
Sources and Collection of Consumer Health Data
Depending on the personal information you choose to add to your profile or use to communicate and/or interact with other users on the Service, or use in connection with other relevant Service features, and/or in the context of your interactions with us and/or with persons we use to provide the Service or to perform functions in connection with the Service, it is possible that you may provide such consumer health data as individual health conditions, treatment, diseases or diagnosis; social, psychological, behavioral and medical interventions; health-related surgeries or procedures; use or purchase of prescribed medication; bodily functions, vital signs, symptoms or measurements of other types of consumer health data; diagnoses or diagnostic testing, treatment or medication; gender-affirming care information; reproductive or sexual health information; or data that identifies a consumer seeking health care services.

You also may choose to provide, and/or we may request that you provide (which you can decline to provide), certain information which may be considered biometric data. In addition, we collect your geographic location information, which may be considered precise location information where it could reasonably indicate your attempt to acquire or receive health services or supplies, and health and safety data such as a safety incident on or off the Service, each in certain circumstances. Outside of the foregoing situations, we prefer that you never provide us with consumer health data.
Use and Disclosure of Consumer Health Data
We primarily use any of the above categories of consumer health data we collect for purposes of providing, operating and improving the Service and protecting the Service and our community, as described in our Privacy Policy and/or as permitted or required by applicable law. We may share any of the above categories of such consumer health data as reasonably necessary to provide, operate and improve the Service and to protect the Service and our community, as otherwise described in our Privacy Policy and/or as permitted or required by applicable law. For example, we may share any of the above categories of consumer health data with:

  • other users or the public in the context of Service features, such as when we disclose your profile or other Service information and/or regarding user submissions on the Service, each in certain circumstances;
  • persons we use to provide the Service or to perform functions in connection with the Service;
  • other parties in the context of business changes;
  • other parties for legal and safety purposes; and
  • your consent or at your request.
We may use or share any of the above categories of consumer health data to prevent, detect, protect against, and/or respond to security incidents, identity theft, fraud, harassment, malicious or deceptive activities and/or any activity that is illegal under applicable state or federal law; to preserve the integrity and security of our systems; to investigate, report, or prosecute those responsible for any illegal action under applicable state or federal law; and as otherwise permitted or required by applicable law. Your Rights
You have the right to:

  • confirm whether we collect, share or sell your consumer health data;
  • access your consumer health data, including a list of the third parties and affiliates to which such consumer health data may have been shared or sold;
  • withdraw consent from our collection and sharing of your consumer health data; and
  • delete your consumer health data.
You may exercise any of these rights and appeal a decision made regarding your request by submitting a support request to https://support.scruff.com or https://support.jackd.com. We will provide a written explanation of an appeal decision and, in the event we deny such appeal, instructions on how to contact the state attorney general for further review. We will not discriminate against you for exercising any of your rights.
